In order to issue a driver’s license or state identification card, Virginia now requires that a person verify his or her legal immigration status. This “legal presence” requirement went into effect on January 1, 2004. Some Virginia residents who had licenses prior to this date may not be required to show proof of legal presence if their license have not expired or been suspended since that date. The Department of Motor Vehicles website has a comprehensive list of documents that can be accepted to fill the legal presence requirement, including visas, receipt notices, ID cards, and status grant letters issued by the Department of Homeland Security or the Department of State.
